Lisa Kay West last year shelled out $33,000 for a Volkswagen Golf TDI at an Athens dealership because she liked that the diesel engine car was touted as being environmentally friendly.
Now, the Madison County woman is suing the German automaker in federal court for selling her a bill of goods.
Volkswagen last month admitted it equipped some 11 million of its diesel engine cars with so-called “defeat devices,” or software enabling the vehicles to trick emissions tests, hiding the fact they put out as much as 40 times the amount of pollutants than allowed under the Clean Air Act.
Upon learning these developments, West came to understand she was the owner of an illegal car, one that would be expensive to repair, if not possible to re-sell at a large financial loss.
“I was sold a car that wasn’t what I thought I was buying,” she said. “It was supposed to be environmentally friendly, which it turned out not to be.”
West sought out advice on what
her legal options were. She agreed to allow the Athens law firm of Blasingame, Burch, Garrard & Ashley file a class-action lawsuit “on behalf of herself and all others similarly situated.” The complaint against Volkswagen was filed Sept. 23 in U.S. District Court in Athens. It’s just one of many such class-action lawsuits now pending across the country against Volkswagen for selling the illegal cars.
“All these folks now have illegal cars, and if they were to try to sell them they would have to represent the cars as such, which makes them unmarketable,” said West’s attorney, Henry Garrard III. “These folks feel they were misled.”
West said when she and her husband were shopping for a car, they specifically looked for a green car that offered good gas mileage. They settled on Volkswagen because of the automaker’s reputation for making solidly-built cars that also had the eco-features they wanted.
“I care about the planet,” West said. “I have grandchildren and I want to keep the environment safe for them for years to come.”
So-called clean diesel Volkswagens with defeat devices were manufactured between 2009 and 2015 and include the TDI (turbocharged direct injection) versions of the Jetta, Golf, Pasat and Beetle, as well as the Audi A3.
The cheating scheme was announced Sept. 18 by the U.S. Environmental Protection Agency, which called on Volkswagen to recall some 500,000 cars with falsified emissions data. Volkswagen’s CEO subsequently resigned and authorities in Germany have launched a criminal investigation.
Garrard estimates as of this week, about three dozen class-action suits were filed against Volkswagen in federal courts across the country. The lawsuits could be consolidated and placed before one judge, given the length and complexity of the litigation.
Attorneys at the Athens law firm of Blasingame, Burch, Garrard & Ashley had not determined whether they will push for consolidation.
“We have not yet decided what our position will be,” Garrard said. “We’ve got to decide strategically what is best for the people in the state of Georgia.”
It will be up to a federal judicial panel to decide whether the Volkswagen litigation should be bundled in a single case. If so, the panel would choose which judge presides over the case.
The Judicial Panel on Multidistrict Litigation has scheduled a hearing on the matter for Dec. 3.

Security researchers have disrupted an online criminal operation they estimated drew $30 million per year pushing ransomware on unsuspecting people browsing the Internet.
The takedown was performed by investigators from Cisco Systems' Talos security unit, which was researching the Angler Exploit kit. The hack-by-numbers tool is sold in underground crime forums to people who don't want to go through the hassle of developing and testing exploits themselves. Angler is one of the most potent of the exploit kits available, with the ability to successfully infect an estimated 40 percent of the end users it targets using attack code that surreptitiously exploits vulnerabilities in browsers and browser plugins. In most cases, the security flaws have already been patched, but, in some cases, the kits exploit zero-day vulnerabilities for which there is no currently available fix.
The Talos researchers quickly noticed that a large percentage of infected end users were connecting to servers operated by service provider Limestone Networks. After getting the cooperation of Limestone and examining some of the servers responsible for carrying out the operation, the researchers found that the single operation was targeting as many as 90,000 end users per day. They estimated that if just three percent of targets paid the average ransom demand of $300, the operation would generate more than $30 million in 12 months. The estimate is consistent with log files retrieved from just one of the servers accessed by Talos researchers. It showed the operation generating more than $3 million.
"This is a significant blow to the emerging hacker economy where ransomware and the black market sale of stolen IP, credit card info and personally identifiable information (PII) are generating hundreds of millions of dollars annually," Talos researchers wrote in a report published Tuesday about the takedown.
Ransomware came into vogue in 2013 with the rise of a malicious title known as CryptoLocker. It got installed either by posing as a benign piece of software or through an exploit kit such as Angler. Once installed, CryptoLocker silently encrypted all files stored on hard drives or network devices and then demanded $300 in semi-anonymous bitcoins to provide the decryption key. After the past two years, huge numbers of people—including some inside police departments, government agencies, and small- and medium-sized businesses—have fallen victim to scores of copycat campaigns.
Talos estimates that the now-shuttered operation was responsible for about half of the Angler activity its researchers have observed. The researchers observed Angler being used to distribute non-ransomware payloads as well, including what's known as the Bedep downloader, which is malware that delivers additional payloads. Talos also saw malware used in click fraud scams and several instances of keyloggers.
"It's one of the most innovative exploit kits available today, but it doesn't have a large footprint from an infrastructure perspective," they wrote referring to the Angler. "Despite not having a large footprint, Angler is able to compromise a significant amount of users, for a presumably small amount of customers."

ILLINOIS (KMOV.com) - The Illinois Attorney General warned residents Tuesday about identity theft.
The threat stems from a security breach at T-Mobile that compromised the personal information of 15,000,000 customers. More than 700,000 Illinois residents may have had data - including social security numbers - stolen.
Lisa Madigan suggested potential victims place a 90-day fraud alert with the three credit agencies, warning agencies of the possible theft. She said phishing attempts and unsolicited calls or emails offering credit monitoring or identity theft services should be ignored.

Windows 10 Edge browser

Another metrics vendor weighs in with data, shows Edge run by just 12% of Windows 10 users in the U.S.


Microsoft's new Edge browser has been largely ignored by U.S. users of Windows 10, an online measurement company said Monday.
Instead, Google's Chrome has shanghaied Windows 10's top browser spot.
Although Edge -- the default browser bundled with Windows 10 -- got a temporary boost when the operating system launched in late July, its share of all browsers on the OS quickly slipped from an early peak of about 16% to its current 12%.
According to San Francisco-based Quantcast, Chrome is the dominant browser on Windows 10 in the U.S., with a share slightly north of 70%.

Dragon Ball Super First Look Spoilers: Saiyan martial arts superhero Goku will go through another transformation has he and his companions prepare to save the Earth.

According to Kanzenshuu, in their Nov. 2015 issue Saikyo Jump, an unexpected change will come over Goku as he battles with Beerus. The magazine also included "Dragon Ball Super" episode spoilers that take us to episode 20.
"After the battle with Beerus wraps up, a terrible visitor comes to Satan!?" according to the Toei website Dragon Ball Super Episode 15, which airs on October 18, 2015.
Episode 16 will reveal, "With the battle over, one day Kuririn visits Goku. His unexpected request is...!? on October 25, 2015.
By episode 17, "Some time has passed on Earth. Gohan and Videl's daughter is finally born!!," on November 1, 2015.
"Goku departs Earth and begins training under Whis. The surprising training method is...!?" will be revealed on Nov. 8, in episode 18.
"Goku throws himself into training under Whis. Meanwhile in Hell, you-know-who suffers intense torment," according to the synopsis of Dragon Ball Super Episode 19, which airs November 25, 2015.
"An unprecedented threat bears down on Earth!! At this time, an old friend comes to visit Bulma...!?" in Episode #20 on November 22, 2015.
In "Dragon Ball Super" episode 13, Goku's Super Saiyan God form disappeared and he changed back to a normal-looking Super Saiyan.
 "Dragon Ball Super" episode "This Is the Last Bit of my Power! Conclusion to the Battle of Gods!" will see the finale of Goku's battle with Beerus.
The next major part of "Dragon Ball Super" should be an adaptation of "Dragon Ball Z: Resurrection F."
 "Dragon Ball Z" is broadcast on the Japanese Fuji TV.
Dragon Ball Z was created by Akira Toriyama.

Jay Park just released a new MV last week, but a new one will be coming soon! And not only that, but 4minute's HyunA will be starring in the MV with him!

HyunA's company's representative told OSEN, "HyunA recently filmed for Jay Park's new MV in the area of Gangnam in Seoul. The two acted as the male and female leads of the MV."

They added, "Jay Park and HyunA trained together at JYP Entertainment so they were already friends. Jay Park sent a 'love call' and that's how they filmed this MV together."

Jay Park's side also revealed that filming took place on October 6, and the release date for his album has not been decided yet.

Starship's New Rapper Exy Joins Unpretty Rapstar

On Wednesday, October 7th, Starship Entertainment announced their new artist, EXY, will be joining Mnet's "Unpretty Rapstar 2."  
As EXY joins "Unpretty Rapstar 2," it will be interesting to see how she adjusts to the competition as SISTAR's Hyo Rin is also there to represent the same agency.
Prior to her debut on 'Unpretty Rapstar,' Exy released her first mixtape "Wipe it Out" with the title song the same as the mixtape's title.
Exy's music falls under the genre of moombahton, where the combination of electric dance music (EDM) and hip-hop come together. Moombahton can be best described as electronic reggae.
Watch as EXY makes her debut on "Unpretty Rapstar 2" in upcoming episodes!
